DSM Keep Challenging Series Terms and Conditions

Full Terms and Conditions

These terms and conditions (“Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of these Terms and Conditions and, by participating, all entrants will be deemed to have accepted and be bound by them. Please retain a copy for your information.

Eligibility

The DSM Keep Challenging Series (“Series”) is open to anyone over the age of 18. The Series is organized by the Promoter (Koninklijke DSM N.V.).

No purchase necessary; the Series is free to enter.

Winner selection process

Winners of all prizes will be selected depending on their individual or team’s success in each challenge (see below).

Please note that entrants are grouped into three different categories: DSM employees, corporate partners, and members of the public. All categories are also divided into Men, Women and Mixed teams. The tables will be updated throughout the challenges.

The winners for each table will be determined as follows:

Fitness Challenge

The individual who covers the longest distance, in km, in 60 minutes.

Distance Challenge

The team which covers the longest distance in a 3-week period. A team’s performance is determined by the aggregate of the top 6 of its members.

Please note that throughout this challenge, digital notifications of success will be shared when the aggregate distance of a team reaches certain milestones.

Sportive Challenge

The individual who covers 60 km in the least time (in minutes).

The individual who covers 80 km in the least time (in minutes).

The individual who covers 100 km in the least time (in minutes).

Endurance Challenge

The team which spends the most hours on their bikes in the 2-week period. A team’s performance is determined by the aggregate of the top 6 of its members.

Please note that throughout this challenge, digital notifications of success will be shared when the aggregate hours of a team reaches certain milestones.

Most Improved Challenge

Details of this challenge will be revealed later in the year.

Claim Process for winners

Winners will be notified via email with instructions on how to claim their prize. Winners will be required to follow the next steps within one week of being notified that they are a winner. All reasonable steps will be taken to contact the winner, but if this cannot be achieved within the allotted times scale then the Promoter reserves the right to cancel the prize entitlement, withdraw the win and/or award the prize to the next highest ranked finish in the competition.

The cost of postage and packaging of prizes, where applicable, will be borne by the Promoter but the Promoter will not be held accountable for any loss or damage caused during delivery.

All winners agree to take part in any reasonable publicity without further recompense.

Prizes are non-transferable and cannot be sold or auctioned. Any person found in breach of this term will be disqualified from participating. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winners.

General Terms & Conditions

Partaking in any of the challenges is strictly at participants’ own risk and should only be done by people in reasonable health and in accordance with any local restrictions affecting physical mobility.

The winners are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the prize.

All information provided by entrants must be complete and accurate.

No cash or other alternative gift is available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter. The Promoter reserves the right to offer a suitable alternative of equal or greater value.

The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, or any instructions forming part of this Competitions entry requirements, or otherwise where a participant has gained unfair advantage in participating in the Competition or won using fraudulent means.

The Promoter is not responsible or liable for:

1. any submissions that are lost or delayed due to faulty, failed or erroneous electronic data transmissions communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines satellites, servers, computers or providers utilized in any aspect of this Competition causing delays or disruption

2. claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason. Proof of posting will not be accepted as proof of receipt as a result of inaccessibility or unavailability of the internet.

3. Insofar as permitted by law, any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the competition;

The Promoter reserves the right to use the contents of social media posts shared by entrants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law. Each eligible competitor grants permission for Promoter to use any video/imagery contents for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Participants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content, are theirs to assert. Participants warrant that the materials contain no copyright materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.

Data Protection: The Promoter will only use the personal details supplied for the administration of the Competition and as part of the Competition and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulations (GDPR). You can request access to your personal data, have any inaccuracies rectified, or request deletion of data, by contacting us via dsmchallenge@mcsaatchi.com or by consulting: https://resultsbase.net/privacy. You agree to the use of your personal data as described here. You can withdraw your consent at any time.

The Promoter’s decision in all promotional matters is final.

Any person posting, or seen to be posting, comments during the Competition that are considered bullying, spiteful or upsetting to other participants, associates or directly aimed at the Promoter, will have their comments removed and will be disqualified from the Competition. The Promoter reserves the right to alert the relevant social media platforms to any such behaviour, which may result in the person’s account being frozen pending investigation.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this series and competition or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
